These Terms and Conditions define the rules for using the website and the rules for concluding contracts for custom-made cat balcony products offered by:

Nature of the Website and Services

The website is an informational and service website. It does not operate as an online store and does not enable customers to place orders directly through an automated checkout process.

The Seller offers custom-made cat balconies and cat window enclosures manufactured individually according to the measurements, specifications, and arrangements provided by the customer.

The information presented on the website does not constitute an offer within the meaning of applicable law, but an invitation for customers to contact the Seller in order to discuss and arrange an individual order.

Contact and Order Process

A customer interested in ordering a product should contact the Seller by email, phone, or other communication method made available on the website. To prepare an individual order, the customer may be asked to provide: dimensions and measurement data, installation details and technical information about the window, delivery address, and any other information necessary to prepare the custom-made product.

After receiving the required information, the Seller will present the customer with an individual proposal including product details, lead time, shipping details, and any other relevant conditions. A contract is concluded only after both parties individually confirm the order terms.

Product Characteristics

All products offered by the Seller are custom-made, non-catalogue products, prepared individually according to the customer’s specifications. Because the products are made based on information and measurements provided by the customer, the customer is responsible for ensuring that all submitted dimensions, technical details, and other specifications are complete and correct.

The Seller is not responsible for problems resulting from incorrect, incomplete, or inaccurate data provided by the customer.

Delivery Area and Lead Time

The Seller offers delivery to European countries, the United Kingdom, and the United States. Estimated timeframes: production time up to 15 business days; shipping time approximately 5–10 business days.

The Seller will make reasonable efforts to meet the indicated timeframes, but they are estimates and may change in justified cases, including due to logistics, courier delays, force majeure, or circumstances beyond the Seller’s control.

Shipping Costs

Unless otherwise agreed individually, shipping is offered free of charge. The Seller reserves the right to determine exceptional shipping conditions in special cases, including unusual destination countries, non-standard dimensions, remote locations, or special logistical requirements. If such a case applies, the customer will be informed before confirming the order.

Prices and Payments

Because the website does not operate as a standard online shop, product prices and payment conditions are determined individually during direct contact with the customer. Any payment terms, due dates, and method of payment are agreed individually before the order is confirmed. Unless clearly stated otherwise, all information on the website is informational only and does not constitute a binding price offer.

Right of Withdrawal

The Seller supplies products made individually to the customer’s specifications.

For that reason, and to the extent permitted by applicable law, the customer acknowledges that the standard right of withdrawal applicable to distance contracts may not apply to contracts for goods made to the consumer’s specifications or clearly personalised.

Because each product is manufactured individually based on the dimensions and requirements provided by the customer, the customer is not entitled to cancel or withdraw from the contract after production has started solely because of a change of mind.

This does not affect any rights that cannot be excluded under mandatory consumer protection law.

Complaints and Non-Conformity

The Seller is liable to consumers for lack of conformity of the goods with the contract in accordance with applicable mandatory consumer protection law. To submit a complaint, please contact us at hello@balconycat.com and include: name and contact details, order identification details, description of the issue, photos or documentation where relevant, and the requested way of resolving the complaint.

The Seller will review the complaint and respond within the period required by applicable law. Nothing in these Terms and Conditions excludes or limits mandatory rights granted to consumers under applicable law.

Warranty

The Seller does not grant any separate commercial warranty unless expressly agreed in writing in a specific case. This does not affect the customer’s statutory rights arising from applicable law.

Customer Responsibilities

The customer is responsible for: providing correct measurements and technical details; checking whether the selected product is suitable for the intended installation location; ensuring that local building, housing, landlord, cooperative, condominium, safety, or facade-related rules permit the intended installation; and using the product in a proper and safe manner.

The Seller is not responsible for incorrect installation carried out by the customer or third parties, unless the Seller expressly agreed otherwise.

Product Use and Safety

The customer should use the product only for its intended purpose and in accordance with any instructions provided by the Seller. The customer is responsible for ensuring proper installation, periodic inspection, and safe use after delivery.

The Seller shall not be liable for damage resulting from: misuse or improper installation; modifications made by the customer or third parties; use contrary to instructions; or external factors beyond the Seller’s control.

Intellectual Property

All content published on the website, including texts, photos, graphics, branding, and layout elements, is protected by applicable intellectual property laws. Without prior written consent of the Seller, such content may not be copied, reproduced, distributed, or used for commercial purposes.

Privacy and Cookies

Rules regarding the processing of personal data and the use of cookies are described in separate documents: Privacy Policy and Cookies Policy. These documents apply independently of these Terms and Conditions.

Limitation of Website Functionality

The Seller makes reasonable efforts to ensure that the website functions properly and that its content is accurate and up to date. However, the Seller does not guarantee uninterrupted availability of the website or absence of technical errors. Temporary interruptions, maintenance, updates, or technical issues may occur.

Applicable Law

These Terms and Conditions shall be governed by Polish law, subject to mandatory consumer protection provisions that may apply to customers from other countries.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Final Provisions

These Terms and Conditions enter into force on the date of publication on the website. The Seller reserves the right to amend these Terms and Conditions for important reasons, including legal changes, operational changes, or changes to the website or offered services.

The version applicable to a given order is the version accepted or made available at the time the parties agree the order terms.
